Terms of Use

1. Acceptance and scope

These Terms apply to browsing, searching, saving, sharing, reporting, and activating Offers through the Popusti MK mobile application, as well as use of the public website popustimk.app. A “User” is a natural person who uses the service for personal, non-professional purposes; a “Business” is the independent provider that publishes an Offer; and an “Offer” is the promotion displayed in the service.

By using the service, creating or linking an account, or activating an Offer, you agree to these Terms to the extent permitted by law. If you do not agree, do not use the service. Where the law or the nature of a change requires a separate affirmative action, we will request that confirmation separately.

If the same person also uses the business tools, the separate Business Terms also apply to those activities. These Terms do not replace or amend obligations undertaken as a Business.

2. Age, guest use, and accounts

The service is intended for persons aged at least 18 who can validly accept these Terms. Do not use the service if you do not meet that age or capacity requirement.

Offers may be browsed without a named User account. For technical operation, the app may automatically create a guest Firebase session. Google or Apple sign-in is required to activate an Offer and retain the account’s activation history.

You must provide accurate information, protect access to your device and linked sign-in methods, and must not make an account available to another person. Immediately report any suspected unauthorised access to kontaktpopusti@gmail.com. You can delete the account through Settings → Delete account or through the public deletion page.

3. What Popusti MK provides

Popusti MK is a platform for discovering Offers and, for supported Offers, technically recording activations. The service may enable searching and filtering, a map, saving, optional notifications, directions and contact with the Business, reporting a problem, and activation history.

Unless expressly stated for a particular service, Popusti MK is not the seller, supplier, or provider of the Business’s products and services and is not a party to the sale or other transaction between the User and the Business.

A label indicating that a Business is “verified” means only that the current administrative review of the application and submitted information has been completed. It is not a recommendation, guarantee, or confirmation of the Business’s quality, safety, legality, availability, or financial condition.

4. Offers, purchases, and Business responsibility

The Business supplies and is responsible for the description, photographs, prices, dates, locations, opening hours, quantities, exclusions, and other terms of its Offer. Read the displayed terms before activation or purchase and confirm important details directly with the Business.

The Business is responsible for the legality and accuracy of the Offer, availability, stock, quality and safety of the product or service, charges and taxes, fiscal receipts, warranties, complaints, cancellations, returns, refunds, and all mandatory consumer rights. The terms of a particular Offer cannot take away a right granted to you by mandatory law.

Popusti MK may review, request correction of, hide, or remove an Offer, but such review does not transfer the Business’s responsibility to Popusti MK. For fulfilment, charging, a product, service, warranty, or refund, contact the Business first; you may also report an inaccurate, unavailable, or unsuitable Offer in the app.

5. Activating Offers

Activation is available only for participating Offers while the feature is enabled and requires Google or Apple sign-in. Depending on the Offer, an authorised Business employee enters a secret six-digit PIN at checkout, or the User confirms an online activation to display a code.

• Only an authorised employee may enter the Business’s PIN. Do not request, guess, record, or share a secret PIN.
• Confirming an online activation immediately records the Offer as used and displays the code; the action may not be reversible.
• The rule may permit one activation per Offer, one per day, or multiple activations, and an overall limit may also apply.
• Activation may be unavailable if the Offer has not started, has expired, has ended, is paused, is sold out, a limit has been reached, there is no internet connection, or a security restriction applies.
• You cannot activate an Offer from your own Business and must not use multiple accounts or identities to circumvent a limit.

The activation record confirms only that the platform recorded the action. It is not a fiscal receipt, proof of payment, reservation, guarantee of stock, or guarantee that the Business will fulfil the Offer. Unless the Offer expressly states otherwise, payment is made directly to the Business.

6. Fees, subscriptions, and purchases

In this version, Popusti MK does not charge Users to browse, save, report, or activate Offers and there are no User subscriptions. If a fee for a User feature is introduced in the future, it will be clearly displayed in advance and any consent required by law will be requested.

Current in-app purchases are one-time consumable credits for publishing promotions, available only to verified business accounts. They are not User purchases and are governed by the Business Terms, the rules of the Apple App Store or Google Play, and mandatory law.

7. Reports, support, and submitted information

Reports and messages must be honest, relevant, lawful, and free of insults, threats, fraud, or unnecessary personal and sensitive data. Do not upload or send content that you do not have the right to use.

You retain ownership of content you submit voluntarily. You grant Popusti MK a limited, non-exclusive, royalty-free permission to store, copy, review, and share it with the relevant Business or competent authority only to the extent reasonably necessary for support, investigation, moderation, security, or a legal obligation.

We may request additional information and take action according to the circumstances, but we do not promise that every report will lead to removal of an Offer or account.

8. Prohibited use

You must not use the service for:

• unlawful, fraudulent, threatening, abusive, or discriminatory activity;
• false activation, self-activation of your own Offer, or resale or transfer of codes, records, or accounts;
• circumventing limits, checks, PIN protection, or security or technical measures;
• impersonation, infringement of privacy, defamation, or infringement of copyright, trade mark, or other rights;
• viruses, phishing, automated bots, unauthorised bulk downloading, scraping, or overloading;
• unauthorised access, vulnerability testing, disruption of the service, or access to another person’s data;
• copying, repackaging, renting, reselling, or commercially exploiting the service without written permission;
• reverse engineering or attempting to derive source code, except solely to the extent expressly permitted by mandatory law.

9. External services and links

The service uses or opens external services, including Google and Apple for sign-in, the Apple App Store and Google Play, maps and directions, Business websites and profiles, telephone numbers, and email. Their own terms and privacy policies apply when you use them, and their content and availability are not under the control of Popusti MK.

If the app is downloaded through the Apple App Store and no separate agreement has been provided in App Store Connect, the Apple Standard End User License Agreement also applies to the iOS app licence. These Terms separately govern the Popusti MK service, account, website, Offers, and activations and supplement, rather than replace, that agreement. In the event of a conflict relating to the licence or Apple’s usage rules, Apple’s standard agreement prevails only to the necessary extent. Apple is not a party to these Terms for the service.

10. Limited licence and intellectual property

The app, website, software, design, databases, original text, marks, and other Popusti MK rights remain the property of Popusti MK or the relevant licensor. Text, trade marks, logos, and photographs submitted by a Business remain the property of the Business or its rights holders.

You receive a limited, personal, non-exclusive, non-transferable, and revocable right to use the service for the lawful, personal, and non-commercial discovery and activation of Offers in accordance with these Terms. You do not receive a right to use a trade mark, logo, or other content beyond what is necessary for ordinary use of the service.

11. Privacy and optional permissions

The Privacy Policy explains what data is processed, for which purposes, with which providers, for how long, and how you can exercise your rights. Acceptance of these Terms is contractual acceptance, not consent to every processing of personal data.

You can disable optional notifications in Settings or in the device’s system settings. You can withdraw location permission in the system settings. You can manage a linked sign-in method through Settings and through the relevant Google or Apple profile.

12. Availability and changes to the service

We endeavour to keep the service accurate, secure, and available, but do not guarantee uninterrupted operation, the continued availability of a particular Offer, a particular saving, number of Businesses, or result. Maintenance, updates, networks, devices, app stores, and external services may temporarily restrict operation.

We may reasonably add, modify, restrict, or discontinue a feature and correct, hide, or remove an Offer. Such a change does not cancel rights already acquired, applicable obligations of a Business, or rights that cannot lawfully be restricted.

13. Restriction, suspension, and termination

You may stop using the service, sign out, or delete the account. Deletion removes the account and available history in accordance with the Privacy Policy and the deletion page.

Popusti MK may restrict or suspend access where reasonably necessary to prevent harm, fraud, a security incident, unlawful conduct, a serious or repeated breach, or to comply with a legal obligation. Where reasonably possible and legally permitted, we will provide notice and an opportunity to request a review.

Termination does not affect rights, claims, or obligations that arose previously, or provisions that by their nature should remain in force.

14. Warranties and limitation of liability

To the fullest extent permitted by law, the service is provided as currently available. We do not guarantee that every item of information supplied by a Business will always be complete or current, or that the service will be uninterrupted or error-free.

Popusti MK is not liable merely because it displayed an Offer for a product, service, act, or omission under the control of an independent Business. This does not exclude Popusti MK’s liability for its own obligation where that liability cannot lawfully be excluded.

To the extent permitted by law, Popusti MK is not liable for indirect, consequential, special, or punitive loss that was not reasonably foreseeable. Nothing in these Terms limits a mandatory right or remedy, or liability that cannot be excluded or limited, including liability for fraud, wilful misconduct, gross negligence, or injury to life or body where applicable law so requires.

15. Governing law and disputes

These Terms are governed by the law of the Republic of North Macedonia. This choice does not deprive you of mandatory consumer protection or a competent court and procedure available to you under applicable law.

Courts with subject-matter and territorial jurisdiction have jurisdiction over disputes, unless mandatory law provides for another competent court or procedure. Before bringing proceedings, you may, but are not required to, write to us so that we can try to resolve the issue practically.

16. Changes, language, severability, and contact

We may amend the Terms because of changes to the service, risks, or legal obligations. We will publish a new version and date and provide reasonable notice of material changes. We will request a new affirmative action where required by law or the nature of the change.

The Macedonian version is authoritative. Translations and summaries are provided to aid understanding; if mandatory law requires otherwise, that law prevails.

If a provision is invalid, the remaining provisions continue to apply, and the invalid provision will apply to the closest extent permitted by law. A failure to enforce a right in one instance does not waive that right.
